Product Liability

What is Products Liability?

Products liability refers to the legal responsibility of manufacturers, distributors, and sellers of products for any injuries or damages caused by those products. It covers any product that is sold or distributed to the public, including consumer goods, industrial products, and medical devices.

There are three main types of products liability claims:

  1. Manufacturing defects, which occur when a product is not manufactured according to its intended design and causes injury or harm.

  2. Design defects, which occur when a product is designed in a way that makes it inherently dangerous and causes injury or harm.

  3. Failure to warn, which occur when a product's manufacturer or seller does not provide adequate warning or instruction regarding the product's safe use, and injury or harm results.

A person injured by a product may be able to bring a products liability claim against the manufacturer, distributor, or seller of the product to recover damages for their injuries.
